Plaintiff was 45 years old at the time of this accident and 47 years old at the time of settlement. Prior to the accident, Plaintiff worked at a commercial bank as a check processor.
DESCRIPTION OF CASE
Plaintiff, who was on her way to work, was walking across Foster Avenue in Brooklyn when she was struck by a large truck, which ran over Plaintiff's right leg. Plaintiff claimed that she was crossing inside the crosswalk and with the light in her favor. The Defendant claimed that Plaintiff was crossing outside of the crosswalk and against a red pedestrian light, while being distracted by talking on her cellphone.
INJURIES/DAMAGES
Plaintiff sustained a displaced oblique right femur fracture and right leg crush injury. The femur fracture required an open reduction internal fixation surgery, and led to a number of subsequent infections and debridement procedures. Plaintiff also suffered psychological injuries.
