DESCRIPTION OF CASE
Plaintiff was on a scaffold removing asbestos from a school when he fell 15-20 feet as a result of unsecured scaffold planks.
INJURIES/DAMAGES
Lumbar disc herniations superimposed upon significant pre-existing disc degeneration. Plaintiff underwent several spinal surgeries. Defendants argued plaintiff's back surgeries were related to his degenerative spine condition caused by his prior employment as a Yucca picker in Ecuador, his manual labor and 6 subsequent motor vehicle accidents and not the fall from the scaffold. The case settled during trial.
