Car Accident Victim Recovers for Neck Injuries
On July 30, 2009, the plaintiff, a 39 year-old customer service technician for a satellite dish company, was injured when his vehicle was rear-ended by the defendant on the Long Island Expressway, causing significant damage to his vehicle. The plaintiff was granted summary judgment on the issue of liability.
The plaintiff sustained a serious neck injury, including multiple herniated discs. After conservative treatment failed, he eventually underwent surgery to his neck which included the insertion of hardware into his cervical spine. The plaintiff also alleged damages for future medical treatment and costs for same as well as diminution of his earning capacity due to his injuries.
Result: The parties participated in a binding arbitration on November 9, 2011, resulting in an award of $2,400,000.
