DESCRIPTION OF CASE
The Plaintiff was struck in the rear by an intoxicated driver. The Plaintiff ultimately underwent neck surgery. A note from the treating surgeon indicated that the plaintiff told him that he had been assaulted several months before the auto accident, sustaining neck injuries. In that same note the the plaintiff indicated that his baseline neck complaints were not changed by the motor vehicle accident. The plaintiff denied making such a statement to the treating doctor, although he admitted the prior assault.
