Recovery Obtained in Construction Fall Fatality Case

On December 22, 2007, the plaintiffs' decedent, a 33 year-old union ironworker foreman, was working at a construction site involving the complete gut renovation of 113 Bank Street, New York, New York, for a subcontractor of the general contractor. As he was walking on the site, temporary flooring upon which he was walking collapsed, causing him to fall approximately 10 feet to the floor below. He eventually passed away at the hospital later that day as a result of his injuries from the fall. He left behind two children, ages 1 and 3 at the time of the accident.

The decedent's estate made a claim for conscious pain and suffering from the time of injury to the time of death and the value of what the decedent would have earned in salary and benefits were it not for his death. The decedent's children made claims for loss of parental guidance and support due to their father's death.

Result: The case settled on October 3, 2011, for $4,475,000. The settlement funds are being placed in a structured annuity which will pay the children approximately $22,000,000 over the course of their lives.
