DESCRIPTION OF CASE
Plaintiff, a union laborer, suffered injuries to the tips of two fingers of his non-dominant left hand when his fingers were caught between metal piping while rigging and hoisting a load. At trial, Defendants argued that they did not violate the Labor Law and that Plaintiff was solely responsible for the accident. The jury unanimously found the Defendants 100% responsible for the accident.
INJURIES/DAMAGES
Plaintiff suffered injuries to the tips of two fingers on his left hand. Four months after the accident, Plaintiff returned to work full-duty. At the time of trial, Plaintiff had not undergone medical treatment for upwards of two years. Defendants claimed that Plaintiff made a complete recovery from his injuries.
VERDICT/SETTLEMENT AMOUNT
$1,850,000. This case settled during trial and just prior to closing arguments during the damages phase of the trial. Just prior to trial, Defendants offered $25,000 to resolve the case. This matter was handled by S. Joseph Donahue, Esq. and Jeffrey A. Block, Esq. of the firm.
