Wife Recovers in Wrongful Death Lawsuit
On February 28, 2010, the plaintiff's decedent, a 51 year-old Verizon worker, was struck by defendant's van while crossing Castle Hill Avenue in the Bronx. Decedent was rushed from the scene to Jacobi Medical Center, where he died 3 days later.
The decedent's wife, as administratrix of his estate, made a claim for conscious pain and suffering from the time of injury to the time of death and the value of what the decedent would have earned in salary and benefits were it not for his death.
Result: The case settled for $1,000,000, the full amount of the available insurance coverage for defendant's vehicle.
